You do not have to own the drugs or drug paraphernalia to be charged with possession. And you do not have to be in the process of selling drugs to be charged with Drug Trafficking (it is entirely based on the weight of the controlled substance in your possession). Some people find a way to resolve their charges by applying to Drug Court and completing the requirements assigned by the judge. This often includes random drug tests.
